It's like the music industry, after the first few years the sales become so insignificant that they might as well be zero. Hense abandoning. Sure, if it's a good one you may come out with a compliation a little while later, hense the ESA. But otherwise they're not going to suport it any more so it goes on the black list.
Now, as for us as a consumer, yes it seems a waste to spend money on a game only to get it for free years later, and maybe it is. But personally I don't mind paying for a new game so i can play it now instead of maybe finding it for free far enough down the road that it crosses from "warez" to "abandonware."
