It sure is. The thing is, the games makers/publishers may not be the company holding the copyright. If that was always the case it wouldn't be very hard to avoid making ESA protected games available for download, and I doubt the people here on abandonia would have done it.
Edit: And btw, I'm not proposing making such a list, I'm merely asking if anyone knows if it exists.
