With Bethesda giving delivering on Sept 13, 2013 The Elder Scrolls Anthology. Does that make both games no longer freeware?

That depends entirely on Bethesda. But as far as I can see, they continue to provide the free downloads, so nothing would change.

Freeware status trumps sold status as far as we are concerned, and unless Bethesda explicitly states they no longer wish for those games to be available freely we should consider them such.
