The developer (Monolith Productions) is an ESA member but the game is not protected since 26.09.2010.
Sold only on Amazon Marketplace (also on the German and the French ones).

I think we can label this as 'approved'.

Game is sold on German Amazon. Its send through Amazon so it count.

Also please no : and ' in the Title. : isnt supported (you know if you try rename a File with that Symbol) and AB has problem with ' so its always removed from archive.

It's not really sold through German Amazon but rather by their Marketplace. If it was 'Fulfilled by Amazon' (like in this example from Amazon.com), it would be a sign called 'Versand durch Amazon.de' (like here).

Except those copies are under "Gebraucht", which means "Used". Pre-owned units don't count, remember?

After re-checking to see if there were other sellers which could be considered valid, and finding none, and after the Fifth Horseman's clarification on the matter of the validity of the German Amazon Marketplace buylink, I can now say this game meets Abandonia's Definition of Abandonware. Therefore...
