If the game is out of stock does it mean it's available or is it still ESA'd ?

3 years how come? Don't copyrights last some 25 years after the death of the authpr, and Sid Meier is still alive :P

I am talking about the list, and how it lists AW status for ESA protected games.

If you want to go technical, Software Rights lasts 90 years. But as soon as Mickey Mouse is 90 years, be prepared to have the rights extended even further. Disney was the company who made the current rule, as otherwise Mickey Mouse would be public property by now.
