Tom, you'd be surprised in some cases... Like Chaos Gate - the current copyright holders are completely ignorant to the fact they have them. When certain people were asking for a permission to use the music from the game in a mod for Dawn of War, the reply they received was along the lines of "We have never heard of this game". Go figure... And at the same time, since the holder is an ESA member, if anyone put the game up for D/L, ESA would sue them to death. |

BeefontheBone | Or pirate their current titles, either - the ESA's main purpose is nothing to do with abandonware at all - this is just the bit of their remit that we notice, since this is an abandonware site.

You are wrong there. All the members of ESA are members BECAUSE they themselves don't want people to download ANY of their games withouth THEIR consent. |

Actually, ESA acts often without any knowledge or will of the participant companies. What actual company would really care about a game they have published somwhere in 1986 and have long since stopped selling? ESA, however, does, and they seem to find some sort of perverse pleasure in digging up old copyrights that none of the current company staff or management even remember. |

a1s | you'll be surprised to know that ESA has lots of other fuctions. in short they are sort of like a big game maker syndicate, and that scares the poo out of me.

They're like the gaming police. But unfortunatly that sounds stupid, so they named themselves the ESA. |

BeefontheBone | They don't make the decision, it's made by the companies who own the rights - the ESA just enforce their wishes, because that's what they're paid to do.

It would be nice if they provided thourough explanations to as of why the have removed their games from abandonware status though. I fully understand and respect their rights, they can do with their game what they want. It would just be nice to know why they choose to withdraw their works from the public domain. What is the point in a game if not to be played? |

The Fifth Horseman | Exactly, even if they wanted to run their master copy over with a car. Their game, their right.

Besides the ESA does have every right to do what they do. Those companies own the rights to their games and can do (or not do) with them whatever they please. |
