I think the latter would be totally illegal, especially if they don't pay royalties. Secondhand or "dead" stock wouldn't pay royalties anyway, but that wouldn't make it supported software, especially if it's been lying in a warehouse for umpteen years, next to old Health Walkers and Bedazzlers. Some movie or other called it "infomercial hell", lol.

And it's surprising what people will sell when it's not for resale. I found a whole shelf of Gideon's Bibles in a book exchange once :weird:

Luchsen For sold status it doesn't matter if they're an official reseller since we want to support stores selling old games. It's a horse of a different colour when a store does the things Fifth Horseman mentioned.

At any rate, I'm going to make a list of the publishers with oldware on CDAccess and draft an email asking them to confirm or deny this. If the admin staff here want to put their names to it they can do so, otherwise I'll represent myself strictly as a private individual.
You have my support.

The Fifth Horseman The only things we could say is that some of their operation and stock seems to be rather suspicious:
* They offer some games in package formats those games were never originally published in
* They offer some games whose description admits are labeled "Not for resale" (likely copies from magazine cover CD's or OEM's) - and thus are violating that very rule.
* They used to offer pre-orders of games which were known for a long time to have been cancelled (I think archive.org could help in digging up the proof for alleged availability of Full Throttle 2)

I couldn't agree more.
